Welcome to Ocean Avenue Beauty (“OAB,” “we,” “us,” or “our”). We operate this website and online store (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you. By using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy and Return & Refund Policy. If you do not agree, please don’t use the Services.

1. ACCESS & ACCOUNTS

You must be the age of majority in your state to use the Services. You’re responsible for the security of your account and all activity under it. Do not share or transfer your account.

2. PRODUCTS & CONTENT

We try to display products accurately, but colors/appearance can vary by device settings. Descriptions, pricing, and availability may change without notice. We may limit quantities or discontinue products at any time.

3. ORDERS

Placing an order is an offer to buy. We may accept or decline any order (e.g., suspected fraud, address issues, out-of-stock). If we change or cancel an order, we’ll contact you using the email/phone provided at checkout. Purchases are for personal use—not resale or export. Your purchases are subject to our Return & Refund Policy.

4. PRICES, TAXES & BILLING

Prices are shown in USD and exclude taxes, shipping, and applicable fees unless stated. Promotions may have separate terms. You agree to provide current, accurate payment and contact info and authorize us (and our payment processors) to charge your payment method for your order total, including taxes and shipping.

5. SHIPPING & DELIVERY

Estimated delivery dates are not guarantees. We aren’t liable for carrier delays or events outside our control. Title and risk of loss transfer to you when the carrier takes possession. Please ensure your shipping address is accurate.

6. HEALTH & SAFETY

Our cosmetics are for external use only. Discontinue use if irritation occurs and contact us. Nothing on the Services is medical advice.

7. INTELLECTUAL PROPERTY

All content on the Services (text, graphics, logos, product images, video, etc.) is owned by OAB or our licensors and protected by law. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated.

8. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or link to third-party sites. They’re provided “as is” without warranties. Your use is at your own risk. Review third-party terms and policies before engaging with them.

9. RELATIONSHIP WITH SHOPIFY

OAB is powered by Shopify, but your purchases are with Ocean Avenue Beauty LLC, not Shopify. You agree Shopify isn’t responsible for your transactions with us and you release Shopify from claims arising from those transactions.

10. FEEDBACK & USER CONTENT

If you submit reviews, ideas, or other content (“Feedback”), you grant OAB a perpetual, worldwide, royalty-free license to use and display it in any media. You represent you own or control the rights to your Feedback and it doesn’t violate others’ rights or the law.

11. PROHIBITED USES

Don’t use the Services for unlawful purposes; to infringe IP rights; to harass, defame, or harm others; to transmit malware or spam; to scrape or interfere with the Services; or to bypass security. We may suspend or terminate access for violations.

12. ERRORS & CHANGES

Occasionally there may be typographical errors or omissions. We may correct them and update information or cancel orders if any info is inaccurate, including after you’ve submitted your order.

13. DISCLAIMER OF WARRANTIES

Except as expressly stated by OAB, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don’t allow certain disclaimers; some rights may not apply to you.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, OAB and our affiliates, officers, employees, agents, and service providers won’t be liable for indirect, incidental, punitive, special, or consequential damages (including lost profits or data) arising from your use of the Services or products. Our aggregate liability shall not exceed the amount you paid for the product(s) giving rise to the claim.

15. INDEMNITY

You agree to indemnify and hold harmless OAB, Shopify, and our respective affiliates, officers, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.

16. TERMINATION

We may suspend or terminate the Services or your access at any time. Sections that by their nature should survive (e.g., IP, Feedback, Disclaimers, Liability Limits, Indemnity, Governing Law) will survive termination.

17. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You and OAB consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any dispute not subject to informal resolution.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes take effect upon posting unless otherwise noted. Your continued use of the Services after changes are posted constitutes acceptance.
